Terms of use

General terms and conditions (Allgemeine Geschäftsbedingungen, AGB) for the Kumpari app and web application. Last updated: 23 September 2026

The German version is the binding one.

This is a translation provided for convenience. The legally binding version is the German Nutzungsbedingungen (AGB); if the two differ, the German version prevails (see section 11). Kumpari is operated by a sole proprietor in Austria, and Austrian law applies. Austrian statutes are cited by their original names with a short explanation in brackets, because they have no exact English equivalents.

Draft – have it checked by a professional before publication.

This text is a template, not legal advice. Entries highlighted in yellow are placeholders. Review and approval are a matter for legal counsel or the Gründerservice of the Wirtschaftskammer (start-up service of the Austrian Economic Chamber; free for sole proprietors). Section 4 (prices) is to be completed only once paid features exist.

1. Scope and contracting party

These terms apply to the use of the software “Kumpari” as an Android app, an iOS app and a web application at kumpari.com (together, “Kumpari”). The provider and contracting party is Erik Che Kreinbucher, sole proprietor, trading as “Miktoya”, Gaugerichtsweg 13a, 6832 Sulz, Austria (“we”). Further details are in the legal notice.

Kumpari is aimed at consumers and businesses alike. If you are a consumer within the meaning of the Konsumentenschutzgesetz (KSchG, Austrian Consumer Protection Act), its mandatory provisions take precedence; individual clauses below are expressly intended for businesses only. Deviating terms of the user do not apply.

By creating an account you conclude a contract of use with us under these terms. The text of the contract is not stored separately; the version in force at any time is available at kumpari.com/de/agb and can be printed. The contract language is German.

2. Service

Kumpari helps groups record and settle shared expenses. In detail:

Not a payment service, no warranty for calculations

Kumpari does not move money. We are not a payment service provider, we hold no funds and we execute no payments. Settlements are carried out by the parties outside the app; Kumpari merely records them.

Balances and settlement suggestions are calculated from the entries made by the members. Splitting produces rounding differences in the cent range, which are distributed according to a fixed procedure. The calculations are an aid, not a binding statement of account; the members themselves are responsible for the accuracy and completeness of their entries and for deciding who pays whom what. Check the amounts before you transfer money.

Kumpari is developed according to the state of the art, but without any promise of a particular level of availability (“best effort”). Maintenance work, outages or circumstances beyond our control (internet providers, hosting, app stores) may temporarily restrict use. We may develop, change or discontinue features as long as the core of the service – recording and settling shared expenses – is preserved or an export of the data remains possible. We will announce the discontinuation of the entire service at least three months in advance in the app, so that you can export your data.

3. Account

4. Costs

Kumpari is currently free of charge. The basic features – creating trips, splitting expenses, balances and settlement suggestion, invitations, CSV export – remain free.

A paid tier “Kumpari Pro” with additional features is planned. For it, the following applies: only those who create a trip and want to use Pro features pay; fellow travellers never pay. Prices, scope, term, cancellation and the handling via Google Play, the Apple App Store or a payment service provider will be added here before launch: [PRICES AND PURCHASE TERMS – add before paid features launch]. For consumers, the withdrawal notice applies.

5. Obligations of users

You undertake

Content you enter or upload remains your property. You grant us the right to store it, process it, sync it between the devices of the members and display it to the members of the respective trip – only to the extent necessary for operating Kumpari.

6. Shared trips, roles and responsibility

7. Unlawful content, suspension and termination

We do not screen content without cause. If we receive a substantiated report of unlawful content or of a breach of section 5, we review it and may – graduated by severity – remove content, block individual features, temporarily suspend an account or terminate the contract of use. We inform the person concerned, stating the reasons as far as legally permissible – in the case of an account suspension by email if a verified email address is on file, otherwise on request –, and you can respond by email to support@kumpari.com. While an account is suspended, signing in is not possible; we then handle data export and account deletion on request via the same address. Reports of unlawful content are received at the same address.

You can end the contract of use at any time without notice by deleting your account. We can terminate the contract with four weeks' notice; for good cause – in particular in the event of serious or repeated breaches of section 5 – also without notice. Before a termination you will be given the opportunity to export your data, unless that would defeat the purpose of the termination.

8. Warranty and liability

For the free use of Kumpari we give no warranty, to the extent permitted by law; for paid services the statutory warranty rights apply, for consumers in particular the Verbrauchergewährleistungsgesetz (VGG, Austrian Consumer Warranty Act for digital content and goods).

We are liable for damage only in cases of intent and gross negligence. For personal injury we are liable without limitation. We are not liable for slight negligence, except in the case of personal injury. Towards businesses, liability is additionally limited to the typical, foreseeable damage and, in amount, to the fees paid in the preceding twelve months; liability towards businesses for lost profit and consequential damage is excluded. Mandatory statutory liability, for example under the Produkthaftungsgesetz (PHG, Austrian Product Liability Act), remains unaffected.

Kumpari is no substitute for bookkeeping or for advice. We are not liable for financial loss arising because members make or withhold payments on the basis of incorrect or incomplete entries. We recommend exporting important trips regularly; we cannot promise protection against data loss caused by circumstances for which we are not responsible (e.g. loss of the device before it has synced).

9. Data protection

How we process personal data is set out in the privacy policy. It is not part of these terms but information provided under Art. 13 GDPR.

10. Changes to these terms

We may change these terms if the legal situation, the features of Kumpari or the technical framework change. We will inform you of changes at least four weeks before they take effect, in the app and – if one is on file – by email. Changes that materially alter the scope of the service to your detriment or that concern fees apply to consumers only with your express consent; if you do not consent, you can end the contract free of charge until the changes take effect, and we can terminate it as of that date. For all other changes: if you continue to use Kumpari after they take effect, the new terms apply; we will point this out expressly in the announcement.
